(He bases his prediction, not on polls, but 13 binary qualifiers <\/span><a href=\"https:\/\/www.nytimes.com\/2020\/08\/05\/opinion\/2020-election-prediction-allan-lichtman.html\"><span style=\"font-weight: 400;\">that are pretty interesting<\/span><\/a><span style=\"font-weight: 400;\">)\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Some advisors and broker-dealers may still sit on their heels, waiting for the new administration to upend the financial services industry again.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Let\u2019s examine, though, why hoping for an administration change to replace Reg-BI is <a id=\"aa1\"><\/a>foolish.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><b>What the Dems Say about Reg-BI<\/b><\/h2>\n<p>\u00a0<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Democratic National Committee explicitly <\/span><a href=\"https:\/\/www.demconvention.com\/wp-content\/uploads\/2020\/07\/2020-07-21-DRAFT-Democratic-Party-Platform.pdf\"><span style=\"font-weight: 400;\">stated in its new party platform<\/span><\/a><span style=\"font-weight: 400;\"> draft that it will \u201ctake immediate action to reverse the Trump administration\u2019s regulation allowing financial advisors to prioritize their self-interest over their clients\u2019 financial wellbeing.\u201d While it doesn\u2019t name the SEC\u2019s Reg-BI by name, we can assume that this is what the party is referring<a id=\"aa2\"><\/a> to.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<h2 style=\"text-align: justify;\"><b>But, could Biden sweep away Reg-BI?<\/b><\/h2>\n<p style=\"text-align: justify;\">\u00a0<\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Even though Democrats are critical of Reg-BI and argue that it does not go far enough, building a suitable replacement is not easy. Their judicial efforts to stop Reg-BI in June did not go as well as they hoped, so it would be down Biden to change the executive leadership and place a new leader at the SEC.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Democrats believe that when workers are saving for retirement, the financial advisors they consult should be legally obligated to put their client&#8217;s best interests first. They will \u201ctake immediate action to reverse the Trump Administration&#8217;s regulations allowing financial advisors to prioritize their self-interest over their clients&#8217; financial wellbeing.\u201d\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Regulatory <\/span><a href=\"https:\/\/www.wealthmanagement.com\/regulation-compliance\/can-reg-bi-dol-rule-be-undone-democrats?NL=WM-27&amp;Issue=WM-27_20200801_WM-27_407&amp;sfvc4enews=42&amp;cl=article_1&amp;utm_rid=CPG09000017110179&amp;utm_campaign=28249&amp;utm_medium=email&amp;elq2=643d9d937f1547cbb0c5071232982851&amp;oly_enc_id=1349J5883412D1V\"><span style=\"font-weight: 400;\">consultants say<\/span><\/a><span style=\"font-weight: 400;\"> that if a regulation has been \u201cpublished in the <\/span><i><span style=\"font-weight: 400;\">Federal Register<\/span><\/i><span style=\"font-weight: 400;\"> as a final rule for more than 60 days, it\u2019s deemed to be a valid regulation. Any administration change will have certainly met that period, <\/span><b>so the process of removing Reg-BI would be challenging<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The federal government is renowned for moving at a glacial pace. First, a notice, then a comment rulemaking, then a feedback process, maybe a court ruling will maintain the Reg-BI standard in the interim.
