{"id":7485,"date":"2020-11-26T13:05:29","date_gmt":"2020-11-26T18:05:29","guid":{"rendered":"https:\/\/rixtrema.com\/blog\/?p=7485"},"modified":"2020-11-26T13:05:32","modified_gmt":"2020-11-26T18:05:32","slug":"regbiden-whats-next-for-reg-bi-in-the-new-administration","status":"publish","type":"post","link":"https:\/\/rixtrema.com\/blog\/regbiden-whats-next-for-reg-bi-in-the-new-administration\/","title":{"rendered":"RegBIDEN: What&#8217;s next for Reg BI in the new administration"},"content":{"rendered":"\n<div style=\"height:50px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">With Biden taking office in January, many advisors are wondering what\u00a0<\/span><span style=\"font-weight: 400;\">the future of Regulation Best Interest looks like.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">There\u2019s certainly been plenty of speculation on the subject, so let\u2019s take a look at what could change during the transition.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Democrats have generally been unsatisfied with Reg BI, believing that it\u2019s not strong enough to keep broker conflicts in check. They may have a point, because unlike the flurry of legal activity from major industry players that preceded the DOL rule, the advent of Reg BI was met with, well, crickets.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">On October 26th, the SEC held a Roundtable on Regulation Best Interest and Form CRS, including regulatory officials from several departments. Several panelists stated that the recordkeeping of many wealth managers is inadequate.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">In light of this, the new administration may be poised to intervene. The Democratic platform does mention they will \u201ctake immediate action to reverse the Trump Administration&#8217;s regulations allowing financial advisors to prioritize their self-interest over their clients&#8217; financial wellbeing.<\/span><span style=\"font-weight: 400;\">&#8220;<\/span> <span style=\"font-weight: 400;\">\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Even if they don\u2019t mention Reg BI by name, you can be sure that\u2019s what they\u2019re referring to. It is worth noting that a party\u2019s platform is often more aspirational than realistic.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Other goals outlined in the platform are \u201cEnding Poverty\u201d and \u201cHealing the Soul of America.\u201d With liberty and chicken soup for all. So even though people have taken the language in the party platform to speculate that Reg BI will be completely scrapped, it\u2019s not so simple.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">James Lundy, a Faegre Drinker partner and former senior attorney in the SEC\u2019s<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Division of Enforcement and the Office of Compliance Inspections and Examinations, states in an article that Reg BI took a considerable amount of resources to enact, and even if democrats oppose the rule they won\u2019t waste those efforts.<\/span><\/p>\n<blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">I think what we will see&#8230; is a more aggressive examination and enforcement approach using Reg BI as a tool in the staff\u2019s arsenal to enforce that new rule aggressively.<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Many are also looking to see if aspects of the DOL rule will seep into new enforcement regulations. The President Elect was, after all, the vice president under the Obama administration, and is likely to imbue some of the spirit of the DOL rule into new regulation requirements.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The DOL rule also survived a battery of lawsuits before eventually being thrown out, showing that parts of the rule do have sticking power. We will have to wait and see if these crop up again under the new administration.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Another factor at play is SEC Chairman Jay Clayton\u2019s announcement that he plans to retire and return to private practice in 2021.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">This allows Pres-Elect Biden to name a successor whose regulatory discretion aligns with his party\u2019s.
